Gay Wedding Locations In The State Of Nebraska
Seventy percent of Nebraska voters approved a state constitutional amendment to ban gay marriages. But, in May of 2005 a federal judge struck down the amendment stating "that under the Equal Protection Clause of the 14th Amendment to the U.S. Constitution, Nebraska cannot ban gay marriages and civil unions."
But in a major defeat for lesbian and gay activists, The 8th U.S. Circuit Court of Appeals re-instated the same-sex marriage ban, stating that the amendment "and other laws limiting the state-recognized institution of marriage to heterosexual couples are rationally related to legitimate state interests and therefore do not violate the Constitution of the United States."
